GENERAL TERMS AND CONDITIONS MARJA LAMME FASHION & AGENCY BV
1. Background
1.1 These general terms and conditions ("Terms and Conditions") apply when the consumer ("Customer") places an order through the website and related pages (the "Website"). The agreement is concluded between the Customer and Marja Lamme Fashion & Agency BV, Zeilstraat 11, Amsterdam. Chamber of Commerce number 34168761, VAT number NL8103.61.334.B01. 1.2 The Customer must be at least 18 years old to order through the Website. In accordance with Dutch law, Marja Lamme Fashion does not accept credit purchases from persons under 18. Marja Lamme Fashion reserves the right to refuse or change an order (e.g., if incorrect personal information has been provided or if the Customer has a record of late payments).
1.3 Marja Lamme Fashion is not liable for products that are out of stock or out of stock. Marja Lamme Fashion is not liable for incorrect images or errors on the Website, such as in product descriptions, technical specifications, incorrect prices, or price adjustments (e.g., due to suppliers or currency fluctuations). Marja Lamme Fashion may correct such errors and change or update information at any time. If an incorrect price is listed for a product ordered by the Customer, Marja Lamme Fashion will notify the Customer and await their approval of the adjusted price before processing the order. All images on the Website are for illustrative purposes only and do not guarantee the quantity, exact appearance, function, or origin of products. Marja Lamme Fashion is not responsible for information provided on the Website by third parties.
1.4 The Website and all its content are the property of Marja Lamme Fashion or its licensors and are protected by intellectual property and marketing laws. Trademarks, (company and product) names, images, graphics, design, layout, and product or service information may not be copied or used without the prior written consent of Marja Lamme Fashion.
2. Agreements and orders
2.1 To order through the Website, the Customer must accept the General Terms and Conditions. By accepting, the Customer agrees to abide by these terms and confirms that they have read the information about personal data and consent to the use of personal data and cookies.
2.2 A purchase agreement is concluded when Marja Lamme Fashion has confirmed the order and the Customer has received an order confirmation by email. Please keep this confirmation for any subsequent contact with customer service. The Customer may cancel the order until it has been confirmed by Marja Lamme Fashion; in that case, any payments made will be refunded.
3. Customer data, etc.
3.1 Marja Lamme Fashion advises the Customer to create a user account. Personal data may be requested upon registration and/or ordering. The Customer declares that the information provided is correct and complete and is responsible for any inaccuracies.
3.2 The Customer shall ensure that only they use the login credentials, shall not share the username and password with third parties, and shall store them securely. If they suspect misuse or unauthorized access, the Customer shall report this immediately. If the Customer fails to do so, they shall be liable for any purchases made using their credentials.
3.3 In case of suspected misuse or violation of the Terms and Conditions, Marja Lamme Fashion may block access to the account and/or provide new login details.
4. Prices, costs and payment
4.1 The prices listed on the Website apply to orders placed through the Website, are in euros, and include VAT. Payment and shipping costs are listed separately.
4.2 Payment is made using the payment methods offered on the Website. Marja Lamme Fashion may require payment in advance and reserves the right to limit or change payment methods if the chosen method does not work at the time of ordering. Any restrictions are stated on the Website.
5. Special promotions and offers
Marja Lamme Fashion may offer special promotions with potentially more favorable terms (e.g., regarding payment or a cooling-off period). These are valid only during the promotional period and for specifically indicated products. Marja Lamme Fashion may withdraw promotions at any time. After termination, the General Terms and Conditions remain in full force and effect. Offers are valid while supplies last and for the specified period.
6. Delivery and shipping
6.1 Products in stock are generally delivered within the number of business days indicated on the website. Unless otherwise agreed (e.g., when reserving non-stock items), delivery will take place within 10 business days of written order confirmation. See the delivery information on the website.
6.2 The expected delivery time is stated in the order confirmation, upon payment, and/or on the product page. Unless otherwise agreed, the Customer may cancel the purchase if delivery is delayed by more than 10 business days through no fault of the Customer.
6.3 When collecting from a delivery point, the Customer must collect within the specified timeframe, presenting valid identification and an order number. Delivery notifications can be sent by email, post, telephone, or text message. A €15 administrative fee may be charged for non-collection.
7. Right of withdrawal
7.1 For online purchases, the Customer has a 14-day cooling-off period after receipt by the Customer or their representative. Within this period, the purchase can be canceled by informing Marja Lamme Fashion.
7.2 Exceptions to the right of withdrawal:
- (a) products that are custom-made or have a clearly personal character;
- (b) products that are missing labels/sales tags and/or which cannot be returned for health or hygiene reasons (e.g. underwear, swimwear, etc.).
7.3 If a product is sealed/labeled, the Customer may not break the seal/labeling when exercising their right of withdrawal. Breaking the seal will void the right of withdrawal.
7.4 You can cancel your purchase by sending a clear message to webshop@marjalamme.nl within the cooling-off period, stating your name, address, order number/invoice number, and product name.
7.5 In the event of cancellation, the Customer is responsible for the return costs and the condition of the product during return shipment. Please return the product within 14 days of notification, well packaged, in good condition, and – where possible – in the original packaging, in accordance with the instructions on the Website.
7.6 Marja Lamme Fashion may offer free returns for certain products; this will be indicated on the Website.
7.7 After cancellation, Marja Lamme Fashion will refund the paid product price. Any reduction in value due to use or damage may be deducted.
7.8 Refunds will be made without undue delay, no later than 14 days after notification of withdrawal. Marja Lamme Fashion may withhold reimbursement until receipt of the product or proof of return (e.g., proof of shipment). Refunds will be made via the original payment method, unless otherwise agreed or if this is not possible.
8. Special conditions
There are currently no special conditions applicable.
9. Warranty and complaints
9.1 Some products are covered by warranty. Information about warranty periods and conditions is available for each product on the Website or in these Terms and Conditions. The warranty covers only original manufacturing defects and not the consequences of changes to function or appearance (such as adjustments, improvements, or other configurations). The order confirmation serves as proof of warranty.
9.2 The right to complain applies to products that are defective under consumer protection law. Report a defect as soon as possible after discovery via the contact details listed on the website. Complaints submitted within one month of discovery are considered timely.
9.3 In the event of justified complaints, Marja Lamme Fashion will reimburse the return costs.
9.4 For justified complaints, compensation will be provided in accordance with applicable consumer legislation. We aim to resolve the complaint within 30 days of receipt, depending on the product and circumstances. Marja Lamme Fashion may reject a complaint if the product is not defective. Guidelines of the Netherlands Authority for Consumers and Markets (ACM) are followed.

The Website may contain links to websites not under the control of Marja Lamme Fashion; other websites may also link to the Website. While Marja Lamme Fashion strives to provide links with similar privacy and security policies, it is not responsible for the protection or confidentiality of information you provide on other websites. Always consult the privacy policies of those websites.
11. Force Majeure
Marja Lamme Fashion is not liable for delays due to circumstances beyond its control, such as general labor disputes, acts of war, fire, lightning, acts of terrorism, changes in government regulations, technical problems, power outages, telecommunication/computer communication problems, and defects or delays by subcontractors. These circumstances result in exemption from compensation and other penalties. In such circumstances, the Customer will be informed at the beginning and end of the period. If they last longer than two months, both the Customer and Marja Lamme Fashion may cancel the purchase immediately.
12. Changes to the General Terms and Conditions
Marja Lamme Fashion may amend these Terms and Conditions at any time. Amendments will be posted on the Website and will take effect from the moment the Customer accepts the Terms and Conditions (when making a new purchase or visit). Visit the Website regularly to stay informed.
13. Severability
If any provision is declared invalid or unenforceable by a competent authority, the remaining provisions will remain in full force and effect, to the extent permitted by law. Invalid or unenforceable provisions will be replaced by relevant legal guidelines.
14. Applicable law and disputes
14.1 Disputes will initially be resolved in consultation with customer service. In the event of a dispute, Marja Lamme Fashion will follow the decisions/guidelines of the Netherlands Authority for Consumers and Markets (ACM).
14.2 Disputes regarding the interpretation or application of these General Terms and Conditions are subject to Dutch law and will be submitted exclusively to the Dutch courts.
